DMCA & Takedown Policy

Overview

MintVault respects the intellectual property rights of others and expects its users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us.

Reporting Infringement

If you believe that content available on MintVault infringes your copyright or other intellectual property rights, you may submit a takedown notice to our designated agent. Your notice must include the following information:

  1. Identification of the copyrighted work — A description of the copyrighted work that you claim has been infringed, or if multiple works are covered, a representative list of such works.
  2. Identification of the infringing material — A description of the material you claim is infringing and its location on the Platform, including the NFT name, collection, URL, or other information sufficient for MintVault to locate the material.
  3. Your contact information — Your name, mailing address, telephone number, and email address.
  4. Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement — A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Our Response

Upon receiving a valid DMCA takedown notice, MintVault will:

  • Promptly remove or disable access to the allegedly infringing material.
  • Notify the user who posted the material that it has been removed or disabled.
  • Provide the user with a copy of the takedown notice and information about how to submit a counter-notice.

Counter-Notice

If you believe that material you posted was removed by mistake or misidentification, you may submit a counter-notice. Your counter-notice must include:

  1. Identification of the material — A description of the material that was removed and the location where it appeared before removal.
  2. Good faith statement — A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  3. Consent to jurisdiction — A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, and that you will accept service of process from the person who filed the original DMCA notice or their agent.
  4. Your contact information — Your name, address, telephone number, and email address.
  5. Signature — Your physical or electronic signature.

Upon receiving a valid counter-notice, MintVault will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, MintVault may restore the removed material.

Repeat Infringer Policy

MintVault maintains a policy for the termination of accounts of users who are repeat infringers. Users who repeatedly upload, mint, or list content that infringes on the intellectual property rights of others will have their access to the Platform permanently terminated.

Blockchain Limitations

Please note that while MintVault can remove or delist infringing content from the Platform interface, we cannot alter or delete data that has already been recorded on the blockchain. Blockchain records are immutable by design. Our takedown actions will remove the content from MintVault's marketplace and prevent further sales through our Platform, but the underlying blockchain transaction history will remain.

Misrepresentation Warning

Under the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. Please ensure that your takedown notice or counter-notice is accurate before submission.
